Aarushi-Hemraj murder case: Talwar couple acquitted, Jamnat also found

The Allahabad High Court on Thursday gave its verdict on the appeal of Rajesh Talwar and Nupur Talwar against the decision of the life imprisonment of the CBI court in the Aarushi and Hemraj murder case. The Court has treated innocent Talwar as innocent and has granted bail to them.

The Ghaziabad Special Court had sentenced the life sentence to the Talwar couple. The couple had appealed in the High Court against this decision.



What is the matter

- On May 16, 2008, 14-year-old Aarushi's body was found in the house of Noida's Jawalay Vihar, while on May 17, the body of Hemraj (45) found dead on the terrace. Aarushi's mistake was sack. In the Aarushi-Hemraj massacre of 2008, the parents of the court Aarushi, Nupur and Rajesh Talwar were convicted. At that time Uttar Pradesh Chief Minister Mayawati handed over the investigation to the CBI.

इलाहाबाद हाईकोर्ट ने बहुचर्चित आरुषि और हेमराज मर्डर केस में सीबीआई अदालत के उम्रकैद के फैसले के खिलाफ राजेश तलवार और नुपुर तलवार की अपील पर गुरुवार को अपना फैसला सुनाया। कोर्ट ने तलवार दंपत्ति की निर्दोष माना है और उनको जामनत दे दी है।

गाजियाबाद की स्पेशल कोर्ट ने तलवार दंपति को उम्रकैद की सजा सुनाई थी। इस फैसले के खिलाफ इस दंपति ने हाईकोर्ट में अपील की थी।



क्या है मामला ?

- 16 मई 2008 को दिल्ली से सटे नोएडा के जवलायु विहार स्थित घर में 14 साल की आरुषि का शव मिला, जबकि 17 मई को नौकर हेमराज (45) की डेड बॉडी छत पर मिली थी। आरूषि का का गलता रेता गया था। 2008 के आरुषि-हेमराज हत्याकांड में अदालत आरुषि के माता-पिता, नूपुर और राजेश तलवार को दोषी मान करार दिया। उस वक्त की उत्तर प्रदेश की मुख्यमंत्री मायावती ने मामले की जांच सीबीआई को सौंपी थी।

अभी कहां सजा काट रहे हैं तलवार दंपति

- नूपुर और राजेश तलवार गाजियाबाद की डासना जेल में अपनी उम्रकैद की सजा काट रहे हैं।

पहले फैसला सुरक्षित रखा था हाईकोर्ट ने

- सीबीआई की स्पेशल कोर्ट ने 6 नवम्बर 2013 को नूपुर और राजेश तलवार को उम्रकैद की सजा सुनाई थी। दंपति ने इस फैसले को इलाहाबाद हाईकोर्ट में चुनौती दी

थी। जस्टिस बीके नारायण और जस्टिस एके मिश्रा ने इस साल 7 सितंबर को अपना फैसला सुरक्षित रख लिया था।

- सीबीआई की स्पेशल कोर्ट में सुनवाई 18 महीने तक चली थी।

कौन हैं तलवार दंपति

- तलवार दंपति दिल्ली-एनसीआर के जाने माने डेंटिस्ट रहे। डॉ. राजेश पंजाबी परिवार से हैं और नुपुर महाराष्ट्रियन फैमिली से हैं। नुपुर एयरफोर्स के अफसर की बेटी हैं

और डॉ. राजेश हार्ट स्पेशिलिस्ट के बेटे हैं। आरुषि का जन्म 1994 में हुआ था।

CBI की दो टीम ने जांच की; एक ने क्लीन चिट दी, दूसरी ने तलवार दंपति को सस्पेक्ट माना

- इस मामले की जांच सबसे पहले यूपी पुलिस ने शुरू की थी। शुरुआती जांच में पुलिस ने तलवार दंपति को शक के घेरे में लिया था। बाद में यह जांच सीबीआई को सौंपी गई।

- इस केस की जांच 31 मई 2008 को उस वक्त के सीबीआई ज्वाइंट डायरेक्टर के हाथ में आई। उन्होंने तलवार दंपति को क्लीन चिट दी और तीन नौकरों को सस्पेक्ट माना।

- इसके बाद सितंबर 2009 में फिर से सीबीआई की दूसरी टीम ने जांच शुरू की। इस बार सीबीआई के अफसर एजीएल कौर ने जांच शुरू की। उन्होंने तलवार दंपति को प्राइम सस्पेक्ट माना।

आरुषि-हेमराज कांड: कब क्या हुआ ?

- 16 मई, 2008 : आरुषि तलवार की बॉडी उनके घर में मिली।

- 17 मई, 2008 : नेपाल के रहने वाले नौकर हेमराज की लाश छत पर मिली, उसी पर आरुषि की हत्या का आरोप राजेश तलवार ने लगाया था।

- 18 मई 2008: जांच में यूपी एसटीएफ को भी लगाया गया। पुलिस ने कहा कि दोनों मर्डर बेहद सफाई से किए गए। साथ ही पुलिस ने माना की मर्डर में परिवार से जुड़े

किसी शख्स का हाथ है।

- 19 मई, 2008: तलवार परिवार के पूर्व घरेलू नौकर विष्णु शर्मा पर भी पुलिस ने शक जाहिर किया।

- 21 मई, 2008: यूपी पुलिस के साथ ही दिल्ली पुलिस भी मर्डर की जांच में शामिल हुई।

- 22 मई, 2008: आरुषि की हत्या ऑनर किलिंग होने का शक पुलिस ने जाहिर किया। इस पहलू से भी जांच शुरु की गई। पुलिस ने आरुषि के लगातार संपर्क में रहे

एक नजदीकी दोस्त से भी पूछताछ की। इस दोस्त से आरुषि ने 45 दिनों में 688 बार फोन पर बात की थी।

- 23 मई, 2008 : पुलिस ने डॉ. राजेश तलवार को मर्डर के आरोप में अरेस्ट किया।

- 29 मई, 2008: जांच सीबीआई के हवाले।

- 01 जून, 2008 : सीबीआई ने जांच शुरू की।

- 03 जून, 2008 : कम्पाउंडर कृष्णा को पूछताछ के लिए सीबीआई ने हिरासत में लिया।

- 27 जून, 2008 : नौकर राजकुमार को अरेस्ट किया गया।

- 12 जुलाई, 2008 : नौकर विजय मंडल अरेस्ट डॉ. तलवार को जमानत मिली।

- 29 दिसंबर 2010: सीबीआई ने क्लोजर रिपोर्ट लगाई। गाजियाबाद कोर्ट ने नौकरों को क्लीन चिट दी लेकिन पेरेंट्स के रोल पर सवाल उठाए।

- 09 फरवरी 2011: मामले में तलवार दंपति बने आरोपी।

- 21 फरवरी 2011: दंपति ने इलाहाबाद हाईकोर्ट से अपील की। हाईकोर्ट ने अपील खारिज कर दी और ट्रायल कोर्ट इनके खिलाफ सुनवाई शुरू करने के आदेश दिए।

- 19 मार्च 2011: सुप्रीम कोर्ट गए। यहां भी राहत नहीं मिली।

- 11 जून, 2012: सीबीआई की स्पेशल कोर्ट में सुनवाई शुरू हुई। इस मामले की सुनवाई जस्टिस एस लाल ने की।

- 26 नवम्बर 2013 : नूपुर और राजेश तलवार को उम्रकैद की सजा। जस्टिस एस लाल ने 208 पेज का जजमेंट सुनाया था।
